Belgium Joins South Africa’s Genocide Case Against Israel at ICJ

Belgium has announced its decision to join South Africa’s genocide case against Israel at the International Court of Justice (ICJ), further intensifying international legal scrutiny over Israel’s military actions in Gaza.

The Belgian government confirmed that it will formally intervene in the case, aligning itself with South Africa’s application filed under the 1948 Genocide Convention. South Africa accuses Israel of committing acts of genocide against Palestinians during its ongoing military campaign in the Gaza Strip—allegations Israel has strongly denied.

Belgium’s move follows similar actions by several countries that have either expressed support for South Africa’s case or initiated legal steps to intervene at the ICJ. As a signatory to the Genocide Convention, Belgium stated that it has a legal obligation to help uphold international humanitarian law and prevent acts that could amount to genocide.

Legal experts say Belgium’s intervention could strengthen the case by reinforcing arguments related to civilian protection, proportionality, and compliance with international law. While intervening states do not become parties to the dispute, they are allowed to present legal opinions on the interpretation and application of the Genocide Convention.

Israel has consistently rejected the accusations, describing them as “baseless” and politically motivated. Israeli officials maintain that the country is acting in self-defence following attacks by Hamas and insists that its military operations comply with international law.

The ICJ, the United Nations’ highest judicial body, has already issued provisional measures ordering Israel to take steps to prevent acts that could fall under the Genocide Convention and to allow humanitarian assistance into Gaza. The court, however, does not have enforcement powers, relying instead on international pressure and diplomatic mechanisms.


Belgium’s intervention underscores growing global concern over the humanitarian situation in Gaza and reflects widening divisions within the international community over Israel’s conduct and accountability under international law.

The case is expected to continue for years, with its outcome likely to have far-reaching implications for international justice, state responsibility, and the enforcement of humanitarian law in conflict zones.
