The reinstated local government chairmen and councillors elected under the platform of the All Progressives Congress (APC) in Osun State have accused the state government of deliberately misrepresenting a recent Federal High Court judgment in a bid to create confusion and public disorder across local government councils.
Addressing a press
conference in Osogbo on Friday, members of the Osun State chapter of the Association of Local Governments of Nigeria (ALGON) and concerned APC stakeholders, through their spokesperson, Barrister (Chief) Adegoke Ogunsola, alleged that the state government had embarked on a campaign of misinformation following the dismissal of Suit No. FHC/OS/CS/147/2025 by the Federal High Court, Osogbo.
According to the group, the suit, filed on September 12, 2025, sought judicial interpretation regarding the commencement and expiration of the tenure of the reinstated APC chairmen and councillors. While the court dismissed the suit on June 15, 2026, the APC officials insisted that the judgment did not validate the local government elections conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025.
The group accused the administration of Governor Ademola Adeleke of using the court ruling to justify what it described as an illegal attempt to install PDP-backed officials in the councils.
They further revealed that the judgment is already before the Court of Appeal, noting that an appeal and motion for stay of execution were filed on June 16, 2026, and duly served on all parties involved, including security agencies.
The APC chairmen maintained that no individual or group claiming victory from the judgment was a party to the suit and argued that there was no court order authorising any takeover of local government secretariats.
According to them, enforcing the judgment while an appeal and stay of execution application are pending could undermine constitutional rights and trigger avoidable tension across the state.
The group also cited portions of the Federal High Court judgment which, according to them, affirmed that the tenure of the reinstated local government officials expired in October 2025, arguing that the court's position raises fundamental legal questions regarding the validity of the February 2025 local government election and subsequent swearing-in ceremony conducted by the state government.
They called on the Osun State Government to respect due process by awaiting the outcome of proceedings before the Court of Appeal rather than encouraging actions capable of disrupting peace in the state.
The APC officials urged residents to remain calm, law-abiding and disregard what they described as misleading interpretations of the court judgment.
They also commended security agencies, including the Nigeria Police Force, Department of State Services (DSS), and Nigeria Security and Civil Defence Corps (NSCDC), for their professionalism and efforts in maintaining peace and order amid the lingering local government leadership dispute.
The group warned that any breakdown of law and order arising from the ongoing controversy should be blamed on those allegedly attempting to enforce their interpretation of the judgment before the conclusion of the appellate process.
